AI Instructions (Drafting)

AI Instructions in Eureka Drafting define how the system generates content for individual document sections. They allow you to customize drafting requirements, content structure, terminology, and the level of detail used when generating documents.

While Templates determine which sections are included in a document, AI Instructions determine how the content within those sections should be written. You can use existing instructions or create custom instructions to match your drafting requirements.

AI Instructions can be useful when drafting patent claims, abstracts, background sections, detailed descriptions, and Office Action Responses that require specific content or drafting approaches.

Browse and Use AI Instructions

Browse the available AI Instructions to find instructions that match your document section and drafting requirements.

  • Use the search and filter options to find the AI Instructions you need.

You can filter instructions by document section, including:

    • Title
    • Abstract
    • Background
    • Summary
    • Claims
    • Detailed Description
    • Office Action Response

You can also browse instructions using the following categories:

    • All Instructions: Browse all instructions available to you.
    • My Instructions: View instructions you have created.
    • Official Instructions: Browse predefined instructions provided by the system.
    • Shared Instructions: Find instructions shared with you.
    • Favorites: Quickly access instructions you have marked as favorites.
  • Before using an AI Instruction, review its content and intended purpose.

    Check that the instruction matches:

    • The task type you are working on.
    • The document section where the instruction will be used.
    • The target patent office or jurisdiction.
    • The relevant technical field.
    • Your intended drafting requirements.

Select an appropriate instruction for the relevant document section in your drafting workflow.

Create an AI Instruction

You can create custom AI Instructions when the available instructions do not fully meet your drafting requirements.

Select Create Instruction to open the instruction creation form.

  • Complete the available fields to define the instruction and where it should be used.

    • Instruction Name: Enter a clear name that identifies the instruction's purpose.
    • AI Instruction Content: Enter the drafting requirements and guidance the system should follow.
    • Instruction Type: Select the appropriate instruction type.
    • Visibility: Configure who can access the instruction.
    • Template Section: Select the document section where the instruction applies.
    • Description: Explain the instruction's intended use.
    • Region: Select the relevant patent office or jurisdiction.
    • Technology Area: Specify the technical field associated with the instruction.

Review the information and instruction content before saving.

  • When writing an instruction, clearly explain what the system should generate and how the content should be structured.

    Consider including the following information:

    • What to write: Define the information or technical content that should be included.
    • How to write it: Specify the preferred structure, terminology, writing style, and level of detail.
    • What to avoid: Identify requirements, restrictions, or issues the system should consider.

For example, an instruction for a patent Background section could ask the system to describe the existing technical problem, explain the limitations of known approaches, and maintain consistent technical terminology.

Keep instructions specific and avoid adding requirements that conflict with the selected Template or other drafting instructions.

  • Dynamic Fields allow you to configure values that need to be supplied for individual drafting tasks.

Use Dynamic Fields only when an instruction requires information that may change between tasks.

For example, a drafting instruction may need a task-specific value such as a technical field or a particular drafting requirement.

If the same requirement applies to every task, consider including it directly in the AI Instruction Content instead.

Configure JPO-Specific Instructions

When creating an instruction for the Japan Patent Office (JPO), select JPO as the Region and choose the relevant Template Section to review its available chapter settings.

Different document sections have configurable parameters and default values.

  • For the Abstract section, you can review and configure parameters relating to:

    • Abstract length
    • Reference numerals
    • Technical problem
    • Technical effects
    • Invention title

The default Abstract length value is 400.

Review the settings to confirm they match your intended drafting requirements.

  • For the Claims section, available settings include:

    • Two-part claim form
    • Functional limitations
    • Multiple dependencies
    • Reference numerals
    • Maximum number of independent claims
    • Maximum total number of claims
    • Indentation settings

The default maximum independent-claim count is 3, and the default total-claim count is 10.

These values can be adjusted according to your drafting requirements.

  • For the Background section, you can configure whether the generated content should include the closest prior art.

Review this setting to ensure that it aligns with the instruction content and the intended document structure.

JPO chapter defaults are configurable product settings and should not be interpreted as statutory limits. Confirm that the selected parameters, default values, and instruction content are consistent before saving.

Edit and Manage AI Instructions

You can manage existing AI Instructions using the available actions in the instruction library.

  • Open an instruction's action menu to view the available management options.

Depending on your permissions, these can include:

    • Preview: Review the instruction content and configuration.
    • Duplicate: Create a separate copy of an existing instruction.
    • Edit: Update the instruction content or settings.
    • Share: Make the instruction available to other users according to the selected sharing settings.
    • Delete: Remove an instruction when you have permission to do so.
    • Star Icon: Favorite your instruction which will get saved into the Favorites tab.

Available management actions depend on the instruction type and your permissions. Official Instructions may not be directly editable or removable.

Best Practices

  • After creating or modifying an AI Instruction, test it in a controlled drafting task.

    1. Select a suitable task and Template.
    2. Apply the instruction to the relevant document section.
    3. Review the generated content against your drafting requirements and source materials.
    4. Identify any missing, inconsistent, or unnecessary content.
    5. Revise the instruction and test it again if needed.

Check that the instruction does not conflict with the selected Template, other instructions, or the task's requirements.

Key Takeaways

  • AI Instructions control how individual document sections are generated, while Templates define the overall document structure.
  • Search, filter, and preview instructions to find ones that match your document section, jurisdiction, and technical field.
  • Create custom AI Instructions to define drafting requirements and use Dynamic Fields when task-specific values are needed.
  • Test and review instructions before wider use and confirm that their settings do not conflict with the selected Template.
